Last Updated: February 6, 2026
1. Scope and Commitment
Ultimate Business Capital ("UBC," "we," "us," or "our") is a Wyoming-based technical sourcing and administrative infrastructure provider. This Privacy Policy outlines our commitment to protecting the proprietary data and privacy of our institutional participants. UBC does not collect personal consumer financial data. Our operations are strictly focused on commercial payment intangibles and specifically identified business receivables.
2. Data Collection and Use
We collect only the information necessary to verify institutional status and facilitate the administrative coordination of asset assignments.
-
Entity Information: We collect legal entity names, EINs, and jurisdictional registration data for the purpose of participant vetting.
-
Contact Data: Professional email addresses and contact credentials are used for transaction coordination and reporting.
-
Verification Data: We collect information required to confirm "Sophisticated Participant" status, including aggregate transaction capacity of $1,000,000 or greater.
3. Protection of Sourcing Intelligence
Any merchant data or asset profiles provided through our AI-driven sourcing infrastructure are considered Proprietary Trade Secrets.
-
Confidentiality: All underwriting data and merchant information is strictly confidential and is not sold or shared with third-party marketers.
-
Administrative Shielding: Our role includes preserving buyer anonymity and protecting sourcing relationships through non-interpretive data reporting.
4. Data Security
We implement institutional-grade technical and organizational security protocols designed to protect our proprietary databases and participant records from unauthorized access. As a firm founded in 2014, we maintain a disciplined approach to data integrity and system security.
5. Notice to California Residents (Jurisdictional Exclusion)
Ultimate Business Capital does not solicit, source assets from, or facilitate transactions for persons or entities residing in, located in, or organized under the laws of the State of California.
-
No Collection of Personal Information: We do not knowingly collect "Personal Information" as defined by the California Consumer Privacy Act (CCPA) from California residents, as our platform is strictly restricted to non-California institutional participants.
-
Right to Opt-Out: Because we do not sell or share consumer data and strictly facilitate commercial asset assignments for business entities, CCPA/CPRA "consumer" provisions generally do not apply to our infrastructure.
-
Verification of Residency: By using this Platform, you represent and warrant that you are not a California resident or entity. UBC reserves the right to immediately terminate access for any user found to be in violation of this restriction.
6. Jurisdictional Governance
This Privacy Policy and all matters relating to data handling are governed by the laws of the State of Wyoming. By using the UBC Platform, participants consent to the exclusive jurisdiction of the state and federal courts located in Cheyenne, Wyoming.
